A mai napon a Korm\u00e1ny beny\u00fajtotta az \u00faj adatv\u00e9delmi t\u00f6rv\u00e9ny tervezet\u00e9t <\/a>az Orsz\u00e1ggy\u0171l\u00e9s r\u00e9sz\u00e9re.<\/p>\n

Els\u0151 olvasat alapj\u00e1n\u00a0 meg\u00e1llap\u00edthat\u00f3, hogy a miniszteri tervezethez <\/a>k\u00e9pest pontos\u00edt\u00e1sok t\u00f6rt\u00e9ntek \u00e9s a t\u00e1rsadalmi egyeztet\u00e9s sor\u00e1n megk\u00fcld\u00f6tt v\u00e9lem\u00e9ny\u00fcnkben<\/a> javasoltak is – legal\u00e1bb r\u00e9szben – megval\u00f3sultak. \u00cdgy a t\u00f6rv\u00e9nytervezet indokol\u00e1sa szerint: “… a Javaslat az Avtv. rendszer\u00e9t\u0151l elt\u00e9r\u0151en a magyar adatv\u00e9delmi rendszerben eddig elfogadott k\u00e9t jogalap mellett, azokat kieg\u00e9sz\u00edtve bevezeti a 95\/46 ir\u00e1nyelv 7 . cikk c) \u00e9s f) pontja szerinti \u00faj jogalapot is, amely sz\u0171k k\u00f6rben, \u00e9s \u00e1tfog\u00f3 garanci\u00e1lis szab\u00e1lyok mellett lehet\u0151v\u00e9 teszi, hogy bizonyos esetekben, speci\u00e1lis \u00e9rdekekb\u0151l az \u00e9rintett hozz\u00e1j\u00e1rul\u00e1sa hi\u00e1ny\u00e1ban, \u00e9s a jogalkot\u00f3 k\u00f6zhatalmi aktusa n\u00e9lk\u00fcl is sor ker\u00fclhessen az adatkezel\u00e9sre.<\/em>” Pozit\u00edv v\u00e1ltoz\u00e1s teh\u00e1t, hogy bevezetik azt az adatkezel\u00e9si jogalapot, mikor az adatkezel\u0151 jogszer\u0171 \u00e9rdekeinek \u00e9rv\u00e9nyes\u00edt\u00e9s\u00e9hez van sz\u00fcks\u00e9g a szem\u00e9lyes adatokra (eleddig ugyanis ez hi\u00e1nyzott a magyar jogban, ami nem kev\u00e9s bossz\u00fas\u00e1got okozott a gyakorlatban).<\/p>\n

M\u00e1sr\u00e9szr\u0151l komoly h\u00e1tral\u00e9p\u00e9s a tervezetben, hogy az adatfeldolgoz\u00e1sra vonatkoz\u00f3 Avtv szab\u00e1lyokat \u00e1tvett\u00e9k, k\u00f6z\u00f6tt\u00fck azt is, hogy tiltan\u00e1k az adatfeldolgoz\u00f3 r\u00e9sz\u00e9r\u0151l tov\u00e1bbi adatfeldolgoz\u00f3 ig\u00e9nybev\u00e9tel\u00e9t, amely szab\u00e1ly nem sz\u00e1mol a realit\u00e1sokkal.<\/p>\n

A 10 milli\u00f3 forintig terjed\u0151 b\u00edrs\u00e1g \u00e9s az adatv\u00e9delmi nyilv\u00e1ntart\u00e1ssal kapcsolatos szab\u00e1lyok a miniszteri tervezethez k\u00e9pest v\u00e1ltozatlanok maradtak.<\/p>\n
