Az Eur\u00f3pa Tan\u00e1cs (ET) Miniszteri Bizotts\u00e1ga 2010. november 23-\u00e1n <\/strong>CM\/Rec(2010)13. sz\u00e1m alatt aj\u00e1nl\u00e1st fogadott el a profiloz\u00e1s \u00e9s az adatv\u00e9delem kapcsolat\u00e1r\u00f3l, amely dokumentum a n\u00e1lunk \u201eautomatiz\u00e1lt egyedi d\u00f6nt\u00e9s\u201d-k\u00e9nt szab\u00e1lyozott adatfeldolgoz\u00e1si technika nemzetk\u00f6zi minimum sztenderdjeit r\u00f6gz\u00edti, melyet mind gyakrabban alkalmaznak banki hitelfelv\u00e9teln\u00e9l, biztos\u00edt\u00e1si kock\u00e1zatok elemz\u00e9s\u00e9hez vagy \u00e9ppen teljes\u00edtm\u00e9ny\u00e9rt\u00e9kel\u00e9shez.<\/p>\n

A \u201eprofil\u201d az ET aj\u00e1nl\u00e1s meghat\u00e1roz\u00e1sa szerint adatok olyan szem\u00e9lyhez rendelhet\u0151 halmaza, ami az egy\u00e9nek valamely csoportj\u00e1ra vonatkozik, m\u00edg a \u201eprofiloz\u00e1s\u201d olyan automatikus adatfeldolgoz\u00e1si technika, amely alatt valamely profil egy\u00e9nhez rendel\u00e9s\u00e9t \u00e9rtik, \u00edgy k\u00fcl\u00f6n\u00f6sen az \u0151t \u00e9rint\u0151 d\u00f6nt\u00e9shozatal keret\u00e9ben az egy\u00e9n szem\u00e9lyes preferenci\u00e1inak, magatart\u00e1s\u00e1nak vagy be\u00e1ll\u00edtotts\u00e1g\u00e1nak elemz\u00e9se vagy j\u00f3sl\u00e1sa \u00e9rdek\u00e9ben.<\/p>\n

A profiloz\u00e1s t\u00e1g k\u00f6rben elterjedt technika \u00e9s alkalmaz\u00e1s\u00e1nak el\u0151nyei k\u00e9ts\u00e9gtelenek, mivel seg\u00edthet a csal\u00e1sok kisz\u0171r\u00e9s\u00e9ben, kock\u00e1zatelemz\u00e9sben, ami k\u00fcl\u00f6n\u00f6sen jelent\u0151s p\u00e9ld\u00e1ul banki vagy biztos\u00edt\u00e1si ter\u00fcleten. Emellett azonban az Eur\u00f3pa Tan\u00e1cs szerint az egy\u00e9nek alapjogainak v\u00e9delme \u00e9rdek\u00e9ben garanci\u00e1kkal kell k\u00f6r\u00fclb\u00e1sty\u00e1zni a profiloz\u00e1s gyakorlat\u00e1t, mivel ez az adatkezel\u00e9si\/adatfeldolgoz\u00e1si technika k\u00fcl\u00f6n\u00f6sen alkalmas arra, hogy az adatalany tudta n\u00e9lk\u00fcl m\u00e1s min\u0151s\u00e9g\u0171 inform\u00e1ci\u00f3kat \/ szem\u00e9lyes adatokat nyerjenek az adatkezel\u0151k, ami h\u00e1tr\u00e1nyosan \u00e9rintheti az egy\u00e9n jogait.<\/p>\n

Az Eur\u00f3pa Tan\u00e1cs ez\u00e9rt \u2013 az 108. sz\u00e1m\u00fa Adatv\u00e9delmi ET Egyezm\u00e9ny moderniz\u00e1l\u00e1s\u00e1ra vonatkoz\u00f3 munk\u00e1ra is tekintettel \u2013 \u00e1tfog\u00f3 javaslatot tett a profiloz\u00e1si technika tag\u00e1llami szab\u00e1lyoz\u00e1sra, melyet jogszab\u00e1lyok vagy \u00e9ppen \u00f6nszab\u00e1lyoz\u00e1s \u00fatj\u00e1n lehet megval\u00f3s\u00edtani.
